Terms and Conditions

These Terms and Conditions govern the provision of services by Chris Edwards, trading as Chris-Cross Creative, based in Kidderminster, UK. By engaging with our services, you agree to be bound by these terms.

1. Definitions

  • “Client”, “you”, “your” – the person or organisation commissioning work.

  • “We”, “us”, “our” – Chris Edwards trading as Chris-Cross Creative.

  • “Services” – any web design, hosting, domain, drone, or creative services we provide.

  • “Deliverables” – any website, photo/video, or other digital assets supplied to the Client.

2. Services Offered

Chris-Cross Creative provides the following services:

  • Web Design & Development

  • Web Hosting & Domain Services

  • Drone Photography & Videography

All services are delivered under an agreed quote or proposal and subject to these terms.

3. Project Process

  • A deposit of 50% is required before any work begins. The deposit is non-refundable and covers time allocated and preparation work.

  • Timelines and deliverables will be outlined in a proposal or email agreement.

  • Client-supplied materials (e.g., text, logos, media) must be provided promptly.

  • Project timelines may be adjusted if client feedback, content, or payments are delayed.

4. Revisions & Scope

  • Minor revisions are included as outlined in the original proposal.

  • Additional revisions or changes beyond the original scope will incur additional charges at our hourly rate.

  • Any extra work will be quoted and agreed before proceeding.

5. Payment Terms

  • Invoices are due within 7 days of issue unless otherwise agreed in writing.

  • Late payments may result in the suspension of ongoing work or services.

  • Final files, websites, or access may be withheld until full payment is received.

  • All charges are in GBP and may be subject to VAT (if applicable).

5.1 Online Payments via WooCommerce & Stripe

Payments made through our website are securely processed using WooCommerce and the Stripe payment gateway. By submitting your payment information, you authorise Stripe to charge the applicable amount.

We do not store or have access to your full payment card details. All transactions are subject to Stripe’s Terms of Service and Privacy Policy.

In the event of a payment issue (e.g., a failed transaction or dispute), please contact us at chris@chriscrosscreative.co.uk and we’ll help resolve it where possible. Refunds, where applicable, will be processed via the original payment method.

6. Hosting & Domains

  • Hosting and domain services are billed annually in advance unless otherwise agreed.

  • Hosting is provided using a UK data centre with a 99.99% uptime guarantee.

  • We take security seriously and implement proactive measures; however:

    • We accept no liability for data loss, hacks, or cyber attacks.

    • Clients are advised to maintain their own backups and use secure passwords.

  • We reserve the right to suspend services for non-payment or abuse (e.g., spam, malware).

7. Drone Services

  • All drone operations comply with UK law and CAA requirements.

  • Flights may be rescheduled due to weather, restricted airspace, or safety issues.

  • Clients must provide accurate location access and consent information.

  • A cancellation fee may apply if access or permission issues are not disclosed in advance.

Usage Rights

  • Drone footage and photography are licensed for use in agreed media (e.g., website, marketing).

  • Content may not be resold or redistributed without written permission.

  • We retain copyright unless otherwise agreed in writing.

8. Third-Party Services

  • We may integrate third-party services (e.g., plugins, hosting providers, analytics tools).

  • We are not responsible for performance, compatibility, or issues caused by these services.

9. Client Content & Responsibilities

  • You warrant that all materials you provide (text, images, videos, etc.) are lawful and do not infringe third-party rights.

  • You are responsible for the accuracy and legality of your content.

  • You agree to supply all required materials and feedback in a timely manner.

  • You must maintain access credentials securely and use our services lawfully.

10. Intellectual Property

  • Full rights to completed work are transferred to the client once payment is received in full.

  • We reserve the right to display work in our portfolio and to include a credit link unless agreed otherwise.

  • Third-party software or assets remain governed by their original licences.

11. Limitation of Liability

  • We are not liable for any loss of data, cyber incidents, or consequential damages.

  • We take all reasonable steps to protect data and maintain uptime.

  • Maximum liability is limited to the amount paid for the relevant service.

12. Force Majeure

  • We are not liable for delays or failure caused by circumstances beyond our control, including natural disasters, war, pandemics, power or internet outages, or other unforeseen events.

13. Data Retention & Termination

  • We may delete data or accounts for unpaid services after 30 days of non-payment.

  • Clients are responsible for backing up their data unless otherwise agreed.

  • Hosting and recurring services can be terminated with 30 days’ notice.

14. Privacy & Data Protection

  • We process personal data in accordance with our [Privacy Policy].

  • Clients are responsible for GDPR compliance if collecting data from their users.

15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts of England and Wales.

16. Changes to Terms
